Terms of Service

These terms form the agreement between you and Axivana when you visit the platform, create an account, or buy digital content. Please read them carefully.

1. About these terms

By using axivana.com you agree to these terms. If you do not agree, please do not use the platform. Where you use Axivana on behalf of an organisation, you confirm you are authorised to bind that organisation.

Axivana is a trading name of Dibos BV, registered at Camiel Verstraetenstraat 1d, 9150 Beveren-Kruibeke-Zwijndrecht, Belgium. You can contact us by email at hello@axivana.com or info@dibos.be, or by WhatsApp at +32456730108.

2. Accounts

  • You must be at least 16 years old to create an account.
  • Your details must be accurate and kept up to date.
  • You are responsible for keeping your password confidential and for activity under your account.
  • We may suspend or close an account that breaches these terms or is used unlawfully.

3. Digital content and your licence

Books, e-books, audiobooks, guides, courses and toolkits on Axivana are licensed, not sold. When you buy or unlock an item you receive a personal, non-exclusive, non-transferable licence to read, listen to and use it for your own learning.

You may not:

  • Resell, rent, sublicense, publish or share the content with others.
  • Remove copyright notices or circumvent access restrictions.
  • Use the content to train machine-learning models or to build a competing product.
  • Copy substantial parts of the platform, scrape it, or use automated harvesting tools.

4. Prices, payment and subscriptions

  • Prices are shown before checkout and include applicable VAT, GST or sales tax where required.
  • Subscriptions renew automatically for the same period until cancelled, and you can cancel at any time before the next renewal date.
  • We may change prices for future billing periods with reasonable advance notice.

5. Right of withdrawal and refunds

Consumers in the European Union and the United Kingdom normally have 14 days to withdraw from a distance contract. For digital content delivered immediately, that right lapses once you expressly consent to immediate delivery and acknowledge that you lose your withdrawal right — which you do at checkout.

Nothing in these terms limits your rights under the Australian Consumer Law. Our digital content comes with guarantees that cannot be excluded: you are entitled to a replacement or refund for a major failure, and to compensation for other reasonably foreseeable loss or damage. Comparable mandatory consumer rights in the EEA, the UK, New Zealand, Canada and the United States also remain unaffected.

6. Availability

We work to keep Axivana available, but we do not guarantee uninterrupted access. Maintenance, updates and events outside our control may cause downtime. We may change, add or discontinue features; where a paid feature is discontinued we will offer a fair remedy.

7. AI features

Axivana AI produces automated answers based on our library and general models. Output can be incomplete or wrong and is not professional advice. Always verify important information. See the disclaimer for more detail.

8. Intellectual property

The platform, brand, design, text, audio and software are owned by Axivana or its licensors and are protected by copyright and trade mark law. Nothing in these terms transfers ownership to you.

9. Liability

To the extent permitted by law, neither Dibos BV, nor its owners, shareholders, directors and employees can be held liable for any damage or loss arising from your use of, or reliance on, Axivana — including indirect or consequential loss, loss of profit, loss of data, or loss arising from health, financial, legal or AI-generated information on the platform. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded — including under the Australian Consumer Law and mandatory EU and UK consumer rules.

By accessing or using axivana.com you acknowledge that you have read and understood this limitation of liability and agree to it. If you do not agree, please do not use the platform.

10. Governing law and disputes

These terms are governed by the law of our place of establishment. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts. EU consumers can also use the European Commission's online dispute resolution platform; Australian consumers can contact their state or territory fair trading office or the ACCC.

11. Changes and contact

We may update these terms. Material changes take effect 30 days after we publish them, or immediately where a change is required by law. Questions? Email hello@axivana.com.
